Do You intend to file for a Standard Character Mark or a Special Character Mark or both?

A Standard Character Mark protects the text of a mark without limitation to presentation, font, color stylization, etc. These kinds of marks can only consist of normal written characters and a selection of punctuation and symbols. This is the type of filing we recommend for most clients as it offers the broadest protection of your name. An example of a Standard Character Mark is the name “Coca-Cola”.

A Special Character Mark protects a specific representation of a given mark and can include images, specific colors, specific fonts, or a combination thereof. These kinds of marks protect only the mark as it is filed. We do not usually recommend filing a special character mark unless: (1) Your trademark consists entirely of an image or (2) You have a very particular element of your branding that is integral to identifying your goods and services (eg. a specific color or combination of colors). If your mark consists of a picture AND text we strongly recommend filing both a special character and a standard character mark.
